Welcome to Venus Beauty. These Terms of Service (“Terms”) are a contract between you and Venus Beauty Catalog LLC (“Venus Beauty,” “we,” “us,” or “our”). They govern your use of venusbeautylab.com, our Shopify storefront (including venus-beauty-6341.myshopify.com), and any purchase of our products.

Please read these Terms with our Terms of Privacy, Returns Policy, and Shipping Policy. Together they form the agreement for the store.

1. Acceptance

By visiting the site, creating an account, placing an order, or otherwise using Venus Beauty, you agree to these Terms. If you do not agree, do not use the site or buy from us.

If you buy for a company, you represent that you have authority to bind that company. That company is also bound by these Terms, unless we have a separate written agreement that says otherwise.

2. Eligibility

You must be at least 18 years old to place an order or create an account. By using the store, you confirm that you are 18 or older and that you can form a binding contract under the laws of Texas and the United States.

The site is not directed to children. See our Terms of Privacy for how we treat children’s information.

3. About Venus Beauty

Venus Beauty is a high-end beauty-tech catalog. We sell LED and laser face masks and related beauty devices and products for cosmetic and wellness use. We sell to individual customers and to businesses that check out on the store.

We operate from Austin, Texas, USA. We fulfill orders through manufacturing partners who ship to the address on your order. We do not promise a United States warehouse or local pickup. Details are in our Shipping Policy.

4. Account

You may browse without an account. Some features, such as order history, may require one. If you create an account, you agree to give accurate information and to keep it current.

You are responsible for your password and for activity under your account. Tell us promptly if you think someone else has used it. We may refuse, suspend, or close an account if we believe these Terms have been broken, if we see fraud or abuse, or if we must do so to protect the store or other customers.

5. Orders and pricing

Prices are in United States dollars (USD). Retail prices are typically presented with a .99 ending. The price that matters is the price shown at checkout when you place the order, plus any taxes and shipping shown there.

An order is an offer to buy. We may accept or decline it. We may refuse, cancel, or limit an order for any lawful reason. That includes suspected fraud, pricing or inventory errors, product unavailability, shipping restrictions, or an order that appears to be for unauthorized resale.

If we cancel after you have paid, we will refund the amount charged for the cancelled items to your original payment method. We will try to notify you using the email on the order.

We may correct errors on the site, including price, description, or availability, even after you submit an order. A listing is not a guarantee that an item is in stock or that it will ship on a set date.

Taxes are calculated at checkout when we are required to collect them. You are responsible for any tax we do not collect that still applies to your purchase.

6. Payment

We process payments through Shopify Payments and the methods shown at checkout. Available methods may change. We do not store full card numbers on our own systems. Payment data is handled by Shopify and its payment partners.

You represent that you are authorized to use the payment method you choose. You authorize us and our payment partners to charge the full order total, including taxes and shipping shown at checkout.

If a charge is reversed, fails, or is charged back, we may cancel the order, pause fulfillment, or seek the amount due. You remain responsible for any amount that is properly owed.

7. Product descriptions

We try to describe products accurately. Photos, wavelengths, materials, and other details are provided in good faith. Devices, finishes, and accessories can vary slightly from images. Packaging may change.

Our devices are sold for cosmetic and wellness use. They are not offered as medical devices or as treatment for disease. We do not claim that any product is FDA-cleared, 510(k) cleared, or approved to diagnose, treat, cure, or prevent any condition. If a product page, ad, or message ever seems to say otherwise, these Terms control.

If a description is materially wrong, contact Venus Beauty through the Contact page or reply to your order confirmation. We will work with you under our Returns Policy.

8. Health and device disclaimer

Venus Beauty products are not medical devices and are not medical advice. LED masks, laser masks, and related beauty devices are for cosmetic and personal wellness use only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Read and follow the instructions that come with your device. Use the product only as directed. Do not use a device if the instructions say you should not, or if a licensed professional has told you to avoid light, laser, or similar treatments.

If you are pregnant, have a skin condition, take photosensitizing medicine, have a history of seizures, have implanted electronic devices, or have any health concern, talk with a qualified professional before use. Stop use and seek professional care if you have pain, burns, irritation, or an unexpected reaction.

You are responsible for using the product safely. We are not responsible for injury or loss that comes from ignoring instructions, modifying a device, sharing a personal-care device in an unsanitary way, or using a product for a purpose we did not offer.

9. Shipping, risk, and delivery

Shipping terms are in our Shipping Policy. Lead times vary by product. Some items can leave in a few business days. Others take longer. We do not promise same-day or next-day shipment. We do not guarantee a delivery date.

You are responsible for a complete and correct ship-to address. International orders may incur customs, duties, or VAT, which you pay.

Risk of loss passes as described in the Shipping Policy and as allowed by law. If a package is marked delivered, start with the carrier and contact us so we can help.

10. Returns

Returns, refunds, and hygiene limits are in our Returns Policy. Opened or used personal-care devices are generally not resellable and usually cannot be returned except when the item is defective or we sent the wrong item.

11. Prohibited uses

You agree not to:

Use the site or products for any unlawful purpose.
Buy products if you are under 18.
Present our devices as medical treatment, or claim FDA clearance or 510(k) status.
Modify, reverse engineer, or tamper with a device except as the instructions allow.
Resell our products without our written permission, or buy in a way that looks like unauthorized wholesale scraping of the catalog.
Interfere with the site, checkout, or other customers. That includes scraping, flooding, introducing malware, or bypassing security or password gates we put in place.
Use another person’s payment method, account, or identity without authority.
Post or send content that is illegal, hateful, infringing, or deceptive.
Use the site to build a competing catalog by copying our text, images, or product arrangement.

We may refuse service, cancel orders, or block access if we reasonably believe these rules were broken.

12. Intellectual property

The Venus Beauty name, our logos, product names, photographs, copy, layout, and other site content are owned by Venus Beauty Catalog LLC or used with permission. They are protected by intellectual property and unfair-competition laws.

We grant you a limited, revocable, non-exclusive license to use the site for shopping and lawful account use. You may not copy, scrape, frame, or republish the catalog for commercial use without our written consent.

If you believe content on the site infringes your copyright, contact Venus Beauty through the Contact page on venusbeautylab.com and include enough detail for us to find the material and respond.

13. User content

If you send reviews, photos, questions, or other content, you grant Venus Beauty a non-exclusive, worldwide, royalty-free license to use, display, and adapt that content in connection with the store and our brand. You represent that you own or control the content and that it does not infringe others.

We may edit or decline to publish user content. User content is not confidential unless we agree in writing. Do not send information you need to keep secret through public reviews or unsolicited messages.

14. Third-party links and tools

The site runs on Shopify. Checkout, payments, analytics, and related tools may be provided by Shopify and other service providers. The site may also link to third-party sites we do not control.

Those third parties have their own terms and privacy practices. We are not responsible for their content or their acts. Your use of a third-party service is between you and that provider.

15. Disclaimer of warranties

To the fullest extent allowed by law, the site and the products are provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, that product pages will always be current, or that a device will achieve a particular cosmetic result. Results vary. Nothing on the site is a guarantee of outcome.

Some states do not allow certain warranty disclaimers. In those states, we disclaim warranties only to the extent the law allows. This does not limit any non-waivable warranty that Texas or federal law gives you.

16. Limitation of liability

To the fullest extent allowed by law, Venus Beauty Catalog LLC and its owners, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. That includes lost profits, lost data, or loss of goodwill, even if we were told such loss was possible.

Our total liability for any claim related to the site or a product will not exceed the amount you paid us for the product at issue in the 12 months before the claim, or fifty U.S. dollars (USD $50) if you did not purchase the product at issue.

These limits do not apply to liability that the law does not allow us to limit, including certain liability for personal injury where a waiver is void. They do apply to the maximum extent the law permits.

17. Indemnity

You agree to defend, indemnify, and hold harmless Venus Beauty Catalog LLC and its owners, officers, employees, and partners from claims, losses, and reasonable legal fees that arise from your misuse of the site or products, your breach of these Terms, your violation of law, or content you submit. We may take over the defense of a claim at our expense. You will cooperate with us.

18. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and by applicable United States federal law.

Please contact us first and give us a fair chance to resolve the issue. Contact Venus Beauty through the Contact page or reply to your order confirmation. Most issues can be solved that way.

If we cannot resolve a dispute informally, you and we agree that the exclusive venue is the state or federal courts located in Travis County, Texas (Austin). You consent to personal jurisdiction there. You and we each waive any objection to venue in those courts.

Nothing in this section limits either party’s right to seek emergency injunctive relief to protect intellectual property or prevent unauthorized use of the site.

19. Electronic communications

When you use the store or send us a message, you agree to receive communications from us electronically. Order confirmations, shipping updates, and legal notices may be sent to the email on your order or account. Those messages satisfy any legal requirement that we communicate in writing.

20. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. The revised Terms apply to new visits and new orders after they are posted. If a change is material, we will try to give additional notice on the site. Your continued use after a change means you accept the new Terms.

21. Severability and entire agreement

If a court finds any part of these Terms unenforceable, the rest remains in effect. These Terms, plus the policies linked above and any order confirmation, are the entire agreement between you and us for the store. They replace prior discussions about the same subject. A failure to enforce a term is not a waiver.

You may not assign these Terms without our consent. We may assign them in connection with a reorganization or a transfer of the business. Headings are for convenience only.
